A lawsuit has been filed after an Arby’s manager was found dead, having froze to death, inside of a walk-in freezer that had a broken latch.

It is reported that the manager, identified as 63-year-old Nguyet Le, died on May 11 after she got trapped inside of a faulty walk-in freezer while opening the restaurant based in New Iberia, Louisiana.

Le, who is a widow and mother-of-four, is originally from Houston, Texas and worked at another Arby’s Restaurant there as well. However, according to the lawsuit, she was only supposed to be at the Louisiana location for a four week assignment.

Le’s son, Nguyen, who also worked at the Louisiana restaurant with his mother, is the person who discovered her body when he arrived to the location later in the morning. He along with other employees called police around 6:19 p.m.

When investigative officers arrived to the scene, they found blood on the inside of the freezer door, suggesting that Le “beat her hands bloody trying to escape or get someone’s attention. Ultimately, she collapsed into a fetal position face down on the frozen floor.”

A preliminary autopsy revealed that Le died of hypothermia. Meanwhile, it was also noted in the lawsuit that the company policy mandated employees to “keep the freezer at negative 10 degrees or colder.”

According to the lawsuit, the latch on the walk-in freezer that trapped Le is said to be the cause of her entrapment. It is claimed that the piece had been broken since August 2022.

However, employees at the store temporarily fixed the latch issue by using a screwdriver to open and close the freezer. They also used a box to prop the door open when they needed to go inside.

Apparently, employees of the store had also shown the faulty freezer issue to a district manager, when they visited the location prior to Le’s death.

Subsequent to the issue never being fixed, Le’s four children have filed a lawsuit against Arby’s for negligence, and they are seeking at least $1 million in relief.

Also named as defendants are Turbo Restaurants and Sun Holdings, which own a thousand plus franchise restaurants in twelve states. These include Burger King, Applebee’s, Arby’s, Papa Johns, IHop, and Golden Corral.

The lawsuit explicitly alleges that Sun Holdings is to blame for Le’s death being that they failed to repair the faulty freezer, and failed to adequately supervise the site in New Iberia. The lawsuit added that Arby’s was “grossly negligent in failing to inspect and train the personnel” at the location.
