The family of a Texas boy who froze to death in their mobile home during an intense winter storm has filed a $100 million lawsuit against ECROT and Entergy.

11-year-old Cristian Pineda died Monday after his family struggled to keep their home warm as the state of Texas remained in single-digit temperatures during a powerful winter storm. The family’s lawsuit is blaming power grid operator ECROT and utility company Entergy for failing to warn customers about the storm along with providing safety guidelines if the power went out. The companies are being sued for gross negligence that led to Cristian’s tragic death.
The family’s attorney Tony Buzbee said in a statement that the boy had no underlying conditions prior to his death. “Common sense tells you the weather played a part in his death. His mother is very adamant, clear that he had no underlying conditions whatsoever that would make him particularly vulnerable to cold weather,” he explained.

Entergy sent their condolences to Pineda’s family and said they couldn’t comment any further due to the pending lawsuit.
“We are deeply saddened by the loss of life in our community. We are unable to comment due to pending litigation.”
