Woman With Spina Bifida Sues Mother ‘s Doctor And Claims She Shouldn’t Have Been Born

An English woman who was born with spina bifida has filed a multi-million dollar lawsuit against her mother’s former doctor claiming she should’ve never been born.

Evie Toombes,20, filed a lawsuit against Dr. Philip Mitchell for “wrongful conception” after he allegedly failed to inform her mother about taking folic acid supplements before getting pregnant. The suit claims this caused Toombes to be born with her birth defect in November 2001 and the bones in her spine never formed properly. Toombes’ attorney states her mother would’ve never had her if she was aware of the treatment affecting her daughter’s health.

“It is her evidence she would have read up on it and wouldn’t have attempted to become pregnant until she was satisfied that she had protected herself as much as possible,”

However, Mitchell’s attorney has argued that it is against his practice to advise his patients that are trying to conceive to take 400 milligrams of folic acid.

Toombes’ quality of life includes her being hooked up to several medical tubes for 24 hours and as reported by the New York Post, she will be confined to a wheelchair as she gets older. Additionally, she has bladder and bowel issues due to the birth defect.
