A transgender woman — who is accused of flashing her penis inside of a female locker room at an Ohio YMCA — was found not guilty of indecent exposure after the judge, presiding in her case, ruled that she was essentially “too fat” for her genitals to show.

It is reported that Judge David McNamee, who presides in Xenia County, Ohio, ruled that Rachel Glines — a transgender woman who previously went by the name of Darren prior to 2021 — did not commit indecent exposure when she was inside of a Xenia YMCA female locker room earlier this year.
According to Xenia Municipal Court documents, it was initially reported that Glines was charged in February with three counts of indecent exposure after witnesses claimed that women, including juveniles, saw a “naked man” in the female locker room with a visible penis.
During court proceedings, the defense argued that their client’s body fat covered the genital area, so there was no way she was indecently exposed.
Judge McNamee eventually agreed and cleared Glines of her charges; adding that there was “little dispute as to the facts of the case,” specifically pertaining to the defendant having permission to even be in the locker room, in addition to her being heavy set, and having her body fat cover her penis.
Judge McNamee stated, “There is no question that [Glines] was in the women’s locker room. However, [Glines] was not charged with trespass, nor was [Glines] charged with being in an area of the YMCA where [Glines] was not supposed to be. Quiet simply, the facts do not exist to support a find of guilt, as charges. Glines’ genitalia was not visible as a result of other portions of her body covering same.”
Additionally, the defense team had noted that the YMCA of Greater Dayton had previously given Glines permission to use the women’s locker room at the location she was at, in addition to all other facilities in the greater area.
Following the incident, the YMCA released a statement that read, “Under no circumstance will we investigate an individual’s birth identity and then assign individuals to locker rooms. That would be counter to the law, counter to respect for all people and it is not who or what we are as an organization.”
