Internal Probe Into Death Of Breonna Taylor Says Louisville Officers Shouldn’t Have Fired Into Her Home

An internal probe into the death of Breonna Taylor that was conducted by two investigators determined that the three Louisville Metro Police Department officers involved, should not have fired shots into her apartment on March 13, 2020.

ABC News obtained documents that said Sgt. Andrew Meyer from the department’s Professional Standards Unit determined that the three officers should have held their fire after Taylor’s boyfriend, Kenneth Walker, fired a shot. Meyer’s report was supported by Lt. Jeff Artman: “They took a total of thirty-two shots when the provided circumstances made it unsafe to take a single shot. This is how the wrong person was shot and killed,” Meyer wrote in his report. He added that the officers involved in the raid that resulted in Taylor’s death – Jonathan Mattingly, Brett Hankison, and Myles Cosgrove – violated the department’s use-of-force policy when they ignored the risk of hitting someone who did not pose a threat, ABC reported. Meyer said deadly force should have only been used against Walker after he fired a shot.

He went on to say, Mattingly “should not have taken the shot” when Walker was not a clear, isolated target, having ducked into a bedroom at the end of a dimly lit hallway, noting that “Taylor’s safety should have been considered before he [Mattingly] returned fire,” Meyer added. Of course, their assessment contradicts what has been said by others in Kentucky law enforcement, ABC noted. As we previously reported, Kentucky Attorney General Daniel Cameron said that Cosgrove and Mattingly were justified in using force because Walker fired a shot.

Lonita Baker, an attorney for Taylor’s family, told local station WHAS-TV, “It’s disappointing that Chief Gentry went against the recommendation of the investigators. Only she knows the reason that she did that,” Baker added, referring to former interim Louisville Police Chief Yvette Gentry’s decision to not discipline Mattingly.

Gentry retired back in January after former Atlanta Police Chief Erika Shields was appointed to fill her position: “I fired people that some believe should have been suspended, I reprimanded people some people (said) should have been exonerated and I overturned what was believed was not appropriate for the situation,” Gentry said in a statement released on Friday, adding, “I still believe in my soul Breonna Taylor should be alive,” ABC News notes.

Only Hankison was charged for his actions in the raid on Taylor’s apartment, but not for her death. He was charged with multiple counts of wanton endangerment for firing three shots into a wall of her neighbor’s. Both Hankison and Cosgrove were fired from the department for violating its policies.

As the Daily Mail notes, the documents were released this week to the newspaper after parts of the investigative file were withheld in April.

Breonna Taylor’s Mom Seeking ‘Real justice’ 1 Year Later: ‘They Should Be Held Accountable’

This Saturday officially marks a year since Breonna Taylor was killed by Louisville Metro Police Officers during a raid at her west Louisville apartment. The Black 26-year-old from Louisville, Kentucky, who was an emergency medical technician studying to become a nurse, was shot multiple times in her home by officers serving a no-knock warrant as part of a narcotics investigation into another man. No drugs were found in her home, and the case fueled nationwide protests against police brutality and systemic racism.

The city agreed to pay Taylor’s family $12 million but her mother says that’s not enough as no officers have been charged in her daughter’s death. Tamika Palmer spoke with CNN, telling the outlet that she will never give up her fight to see the officers criminally charged.

She said “It can’t end here. I’m still out here, I’m still doing what I need to do to get justice for Breonna to make sure that people do right by her.”

Her mother also sat down with WLKY ahead of that day and was asked what sort of emotions come up now, after everything that has happened: “Anger. Still, just like, I can’t believe it’s a year later and we’re still just asking people to do the right thing,” she said.

As we previously reported, only one officer was indicted for what happened that night. No one was charged in her actual death.
Palmer says she feels like the system failed Breonna.

Breonna Taylor Grand Jurors File Petition To Impeach Attorney General Daniel Cameron

On Friday, three grand jurors in the Breonna Taylor case filed a petition with the state House of Representatives, calling for the impeachment of Attorney General Daniel Cameron for mischaracterizing their findings and presenting bs to the media to make himself look better.

According to the Louisville Courier-Journal, the petition alleges Cameron failed in his duties and breached public trust for his handling of the big case. As we previously reported, Cameron was the special prosecutor in the case who presented evidence against the police officers accused of killing Taylor, who was home with her boyfriend when cops opened fire in a botched drug raid. The grand jury indicted just one of the cops, Brett Hankison, after Cameron’s presentation to the panel, but only for bullets that went through a NEIGHBORS’ unit.

RELATED: Two Cops Involved In Breonna Taylor Murder Have Been Fired

Some of the grand jurors said they weren’t given the opportunity to consider homicide charges and at least one of the grand jurors said that Cameron’s public statements about the grand jury involved in the case have been misleading. Kevin Glogower, one of the attorneys representing the petitioners explained: “These are randomly selected citizens who were compelled to sit on a grand jury and were terribly misused by the most powerful law enforcement official in Kentucky,” Glogower said in a news release.

“Neither Cameron nor anyone from his office mentioned any homicide offense to the grand jury. Not only were no homicide offenses presented as alleged, no charges of any kind were presented to the Grand Jury other than the three wanton endangerment charges against Detective Hankinson,” the petition states, according to the Journal. They allege Cameron used the panel as “a shield to deflect accountability and responsibility.”

The petition seeking the impeachment of Cameron on charges of “breach of public trust and failure to comply with duties for misrepresenting to the nation the findings of the Grand Jury” and “abuse of office and breach of duties of professional responsibility and ethics,” — also calls for charging Cameron with incitement of insurrection for the US Capitol riots that took place on January 6, the same charge on which the US House of Representatives impeached former President Donald Trump.

Mayor Greg Fischer made the declaration on Tuesday by signing an executive order titled “Advancing Racial Equity for Black Louisville,” which calls for a focus on “the societal, physical and mental health impacts” on the Black community. As the New York Post notes, the city plans to increase diversity in the ranks of the Louisville Metro Police Department, implement a focus on community policing, and the creation of an independent civilian review board.

This move comes just more than eight months after Taylor was shot dead in her home during a botched police raid. “Breonna’s tragic death has made our city a focal point for America’s reckoning of racial justice,” Fischer said. “The last few months have been painful for us as a community and for many of us personally. The status quo is not working nor is it acceptable.” He added, “As mayor and just as an American and a human being, racism sickens me.” Following Taylor’s death which led to protests in Louisville and around the country, Fischer said “it’s clear that we need to move faster and invest more resources. We need to do everything we can to repair distrust through action.”

“These reforms will require a strong commitment and a lot of work,” Fischer said. “But I believe it can be done — in part because when I look around Lousiville and talk to people from every neighborhood and background, I sense a greater and broader understanding and desire to address racial equity than ever before.”

Louisville Police Officer Sues Kenneth Walker, Boyfriend Of Breonna Taylor, For Emotional Distress, Assault, And Battery

RELATED: Anonymous Grand Juror Says Panel Wasn’t Given Option To Consider Homicide Charges In Breonna Taylor Case

The lawsuit claims the Louisville Sergeant experienced “severe trauma, mental anguish, and emotional distress” because of Kenneth Walker’s actions on March 13.

As we previously reported, Mattingly and two other officers entered Taylor’s apartment early in the morning that day to carry out a drug investigation. Walker, a licensed gun owner who said he thought the officers were intruders, allegedly fired a shot that hit Mattingly in the leg. Police fired back, killing Taylor. She had no criminal record and no drugs were found in their home. “Walker’s conduct in shooting Mattingly is outrageous, intolerable, and offends all accepted standards of decency and morality,” the lawsuit said.

In a statement obtained by CBS News, Mattingly’s attorney Kent Wicker argues: “Mattingly was shot and nearly killed by Kenneth Walker. He’s entitled to, and should, use the legal process to seek a remedy for the injury that Walker has caused him.” Meanwhile, Walker’s attorney called Mattingly’s lawsuit a “baseless attempt to further victimize and harass Kenny.”

“Kenny Walker is protected by law under KRS 503.085 and is immune from both criminal prosecution and civil liability as he was acting in self defense in his own home,” attorney Steve Romines said in a statement obtained by the news site. “Even the most basic understanding of Kentucky’s ‘Stand Your Ground’ law and the ‘Castle Doctrine’ evidences this fact. One would think that breaking into the apartment, executing his girlfriend and framing him for a crime in an effort to cover up her murder would be enough for them,” he added. “Yet this baseless attempt to further victimize and harass Kenny indicates otherwise.”

Walker was initially arrested and charged with attempted murder over the shooting, but those charges were later dropped. Walker has filed a lawsuit of his own against the Louisville Metropolitan Police Department and also sought immunity based on the state’s “Stand Your Ground” law.

“It was a normal day… you know, we went on a date, we went out to eat,” Walker recalled. He said they had gone back home to play Uno and watch a movie. Later, according to Walker, there was “a loud bang at the door.” After asking repeatedly “who is it?” he said no one answered.

“I’m a million percent sure that nobody identified themselves,” he said. “if they had knocked on the door and say who it was, we could hear them. It was dead silent.” Walker, a licensed gun owner said he then grabbed his gun out of fear it would be an intruder.

As his door was smashed down, Walker fired off his gun. Three officers combined then fired 32 shots into their apartment, with “bullets coming in every direction,” Walker said. “I pulled her down to the ground. But, you know, she was scared so she just didn’t get down.”

When the gunfire stopped he looked down he saw Taylor bleeding, but still breathing. From there, he called his mother as he held her. “I told her that somebody just kicked in the door and shot Breonna. And she’s freaking out at this point. But she told me to call 911. So I did,” Walker said. He told King that had he known it was the police who broke in, he would not have called the police for help. “I don’t think I realized that it was the police until I was on the phone with Breonna’s mom,” Walker said. “I thought they was, you know, coming for help. ‘Cause I called 911.”

As he walked outside thinking help was finally here, instead, he was met with guns drawn to him and threats of “dogs and whatever else.” Walker explained that one officer even asked him if he was hit with any bullets. When he replied “no,” the officer replied, “That’s unfortunate.”

“I didn’t know what to think, and I really wasn’t worried about me,” he said. “Only reason I’m even out here is because only way for her to get help in there is for me to be out here.”

During his sit down with King, Walker goes more in-depth about the horrific night but also looks back on some of the great moments he had with Taylor and even shared what they had in store for the future.

New Body Cam Video Released: Swat Team Can Be Heard Saying “She’s Done” After Checking On Breonna Taylor Following Raid

Louisville PD has just released body cam videos from several SWAT officers, showing what went down in Breonna Taylor’s home just moments after she was shot to death by police.

The disturbing video obtained by TMZ shows Breonna Taylor’s motionless body on the floor for several minutes as a SWAT team cleared her apartment, then checked for a pulse before repeatedly stating, “She’s done.”

The clips starts off with SWAT preparing to enter the home. One cop says, “The female is supposedly the one that’s shot” — speaking of Breonna. Taylor’s boyfriend, Kenneth Walker, had already stepped out and surrendered. As they entered her apartment, cops immediately called out that Breonna was at the end of the hallway. However, SWAT took several more minutes to clear other parts of the apartment before addressing Breonna, saying, “Ma’am, can you hear us?” From there, one officer told another to check her pulse. Moments later, the cop declared, “She’s done.” Several SWAT members then left the apartment so crime scene investigators and a medic could come inside the home.

In the footage, the SWAT team also inspected shell casings on the floor, confirming they were from police weapons after trying to figure out whether they were from Walker’s gun. As we previously reported, Walker injured one Louisville cop, Jonathan Mattingly during the raid. He said he had no idea who was entering their home when he fired his gun. Body cam video from outside their apparent shows Walker, through tears, declaring to police that Breonna was dead inside, and that they had no idea who was entering the apartment.

Cops forced entry into the apartment as part of an investigation into drug dealing operations. They found nothing but Taylor was hit by six bullets and died. Despite the heartbreak and trauma Taylor’s death has caused her family and America, the officers responsible for her death were only given light charges. Brett Hankison was charged with wanton endangerment for firing shots into a neighboring apartment.

Kentucky AG Daniel Cameron Says it was “Disgusting” For Megan thee stallion to call him out during “SNL” Performance

Megan Thee Stallion has been using her platform to shed light on Breonna Taylor’s case and to help bring justice to her family. Over the weekend, she performed as the musical guest on the season premiere of “SNL,” and during her set, she included a big message to Breonna Taylor case prosecutor Daniel Cameron.

About halfway through her performance, the sounds of gunshots rang out and Megan Thee Stallion and her dancers paused as audio recording from Malcolm X’s 1962 speech “Who Taught You to Hate Yourself?” played in the background. “We need to protect our Black women and love our Black women,” she said. Then there was an audio clip of activist Tamika Mallory saying, “Daniel Cameron is no different than the sellout Negroes that sold our people into slavery.”

Taylor
(Photo Credit: Breonna Taylor via Facebook)

Cameron, who did not seek charges against officers in Breonna Taylor’s shooting, caught wind of the clip and is now speaking out to respond to her performance. He went on Fox News’ Fox & Friends and said: “Let me just say that I agree that we need to love and protect our Black women,” he began. “There’s no question about that. But the fact that someone would get on national television and make disparaging comments about me because I’m simply trying to do my job is disgusting … because I’m a Black Republican because I stand up for truth and justice as opposed to giving in to a mob mentality.”

He added,

“The fact that a celebrity that I never met before wants to make those sorts of statements, they don’t hurt me but what it does is it exposed the type of intolerance, and the hypocrisy because obviously, people preach about being intolerant,” he continued. “You hear a lot of that from the left about being tolerant. But what you saw there is inconsistent with tolerance. In fact, it’s her disposing intolerance because I’ve decided to stand up for truth and justice.”

Cameron went on say that the officers who fatally shot Taylor in her own home, were justified in returning fire because Taylor’s boyfriend, Kenneth Walker, had fired a warning shot.

“The tragedy, and I’ve said this from the beginning, was that Breonna Taylor was in that hallway next to Kenneth Walker when they returned fire and they hit her,” he said. “No one disputes that this is a tragedy, but sometimes our criminal law is inadequate to respond to a tragedy. Again, my heart goes out to Breonna Taylor’s family.”

UPDATE: Grand Jury indicts Only 1 Officer On Criminal Charges In Breonna Taylor Case

A decision has been made: Just six months after Breonna Taylor was fatally shot by police in her own home in Kentucky, a grand jury has indicted just one officer on criminal charges.

RELATED: UPDATE: Breonna Taylor’s Family To Receive $12 Million Settlement From City Of Louisville

This Wednesday, the jury presented its decision against fired officer Brett Hankison on three counts of wanton endangerment — for firing recklessly and without due regard for life. His bail has been set at $15,000. Wanton endangerment carries a maximum penalty of 5 years if convicted.

As we previously reported, Taylor was shot multiple times by officers who burst into her home on March 13 during a narcotics investigation. NO drugs were found in her home. The indictment has already sparked anger from protestors in Louisville and Rev. Al Sharpton who called it “grossly insufficient.”

To note, the charges against Hankison are not directly for the death of Taylor but for endangering neighbors. The other two officers: Sgt. Jonathan Mattingly and Myles Cosgrove — who had already been placed on administrative reassignment but were still part of the force — have not been charged.

While speaking at a press confrence this afternoon, Kentucky Attorney General Daniele Cameron explained why the use of force by the officers were “justified.” Check out the clip here:

Ben Crump, attorney for the family of Breonna Taylor, was outraged after receiving the news. He tweeted:

“Jefferson County Grand Jury indicts former ofc. Brett Hankison with 3 counts of Wanton Endangerment in 1st Degree for bullets that went into other apartments but NOTHING for the murder of Breonna Taylor. This is outrageous and offensive! He added, “If Brett Hankison’s behavior was wanton endangerment to people in neighboring apartments, then it should have been wanton endangerment in Breonna Taylor’s apartment too. In fact, it should have been ruled wanton murder!”

Earlier, Louisville Metro Police Department announced a state of emergency effective in preparation for Cameron’s announcement on Wednesday. “To ensure we have the appropriate level of staffing to provide for public safety services and our policing functions, effective immediately the LMPD will operate under the emergency staffing and reporting guidelines,” said LMPD Interim Chief of Police Robert Schroeder on Monday.

In a letter obtained by news outlets, the department’s interim chief, Robert Schroeder accused Hankison of “blindly” firing 10 rounds into Taylor’s apartment, creating a substantial danger of death and serious injury. He explained:

“I find your conduct a shock to the conscience,” Schroeder wrote in a Friday letter to Hankison laying out the charges against him. “I am alarmed and stunned you used deadly force in this fashion,” USA Today quotes. He went on to say,

“The result of your action seriously impedes the Department’s goal of providing the citizens of our city with the most professional law enforcement agency possible. I cannot tolerate this type of conduct by any member of the Louisville Metro Police Department,” he added. “Your conduct demands your termination.”

As we previously reported, Breonna Taylor, was a 26-year-old emergency medical technician, who was fatally shot by Louisville Metro Police Department officers on March 13, 2020. Three LMPD officers executing a no-knock search warrant entered her apartment in Louisville, Kentucky. Sgt. Jonathan Mattingly and Myles Cosgrove — had been placed on administrative reassignment but were still part of the force, until Hankison’s Friday firing.
