The NYPD officer who put his knee on man’s neck in the East Village earlier this month will face misconduct charges.

The New York Post reports Officer Francisco Garcia will face misconduct charges as per his suspension after he was caught on camera putting his knee on 33-year-old Donnie Wright’s neck on May 2. The video shows Garcia in plain clothes and using a taser to aggressively confront bystanders as his colleagues tried to arrest two men who violated the city’s social distancing rules near East 9th Street and Avenue D. Wright tried to de-escalate the situation but Garcia grabbed him and threw him onto the sidewalk then punched him several times in the head before placing his knee on Wright’s neck.

A statement from the NYPD says “The internal investigation is recommending discipline for several members of the Department involved in the incident. Charges are expected as early as next week.” Amid Garcia’s suspension, it was discovered he has been sued seven times within the past six years and the city has issued over $200,000 in settlements.

NYPD Commissioner Dermot Shea has condemned Garcia and the other officers’ actions stating he did not agree with the tactics used to arrest citizens.

“I think we got to be better and that’s what was most troubling to me. I would also like to remind you that de-escalation takes two, unfortunately.”
