Officer Fired After Pepper-Spraying Army Lieutenant During Virginia Traffic Stop

Just one of the two Town of Windsor police officers involved in a traffic stop incident involving a Black and Latino U.S. Army officer in uniform has been fired from his job at the police department.

A release stated that Officer Joe Gutierrez was let go following an internal investigation into the incident that occurred on December 5. Officials say in the release, “the pursuit and ultimate stop which resulted in the use of pepper spray against Lt. Caron Nazario by Officer Gutierrez” required an internal investigation to determine the appropriateness of Gutierrez’s actions. “At the conclusion of this investigation, it was determined that Windsor Police Department policy was not followed,” officials said. “This resulted in disciplinary action, and department-wide requirements for additional training were implemented beginning in January and continue up to the present.” 

As we previously reported, Nazario filed a lawsuit against the officers earlier this month, accusing them of pepper-spraying him and pointing guns at him.

He’s seeking $1 million plus punitive damages from the officers, saying they violated his constitutional rights.
