Florida Hospital Sues Patient for Allegedly Refusing to Leave Five Months After Discharge

A Florida hospital has filed a lawsuit against a patient who allegedly refused to leave the facility months after being discharged.

According to Fox 8 Live, Tallahassee Memorial Healthcare filed the complaint earlier this month. The hospital stated that the patient was admitted for treatment but was later medically cleared and no longer required hospital services. The patient was officially discharged on October 6, 2025.

However, according to the filing, the individual has remained inside the hospital for approximately five months since that date.

Hospital Says It Attempted “Safe Discharge”

The complaint states that hospital staff made multiple efforts to assist the patient with a safe discharge.

Those efforts reportedly included contacting family members, offering non-emergency medical transportation, and assisting the patient in obtaining necessary identification

On November 24, the hospital provided the patient with written notice requesting that they leave the premises. Despite those steps, the complaint alleges the patient continued to remain inside the facility.

Hospitals are designed for acute care, not long-term housing. When beds are occupied by individuals who no longer require medical treatment, it can create strain on resources.

Lawsuit Seeks Temporary Injunction

Tallahassee Memorial Healthcare is now seeking a temporary injunction from the court.

The hospital argues that the patient’s refusal to leave is impacting its ability to serve other patients due to limited bed availability.

According to the filing, the continued occupancy has prevented space from being used by individuals who require immediate medical care.
