A Massachusetts funeral home is facing a lawsuit after a family claims their loved one’s casket broke open as it was being lowered into the grave plot and his body fell out.

Last Wednesday, Andrew Serrano’s family filed a lawsuit against the Perez Funeral Home at the Essex Supreme Court in Lawrence. According to the suit, one of the side straps of a city-owned casket lowering device broke and caused Serrano’s casket to break apart in the grave during his funeral in April 2019. Additionally, it caused his body to fall out, leaving the family horrified and distressed.
The documentation also noted that the fall caused Serrano’s body to leak and ooze fluid. Family members also jumped into the gravesite to assist with taking his body out.

Serrano’s body was returned back to the funeral home and buried several days later. His burial took place at the city-owned Bellevue cemetery. In the lawsuit, the family listed the city of Lawrence, the cemetery’s board of trustees, and its directors. Additionally, they are seeking $50,001 in damages due to emotional distress, and negligence from the funeral home.
