The lawsuit was approved by U.S. District Judge Fernando Olguin after he denied McDonald’s motion last Friday. Olguin said the motion was rejected due to the company “improperly referencing material outside of the pleadings”, meaning McDonald’s would have to refile or respond to Allen’s lawsuit by Jan 27. In response, the company claims Allen’s lawsuit is about “revenue not race, and plaintiffs’ groundless allegations ignore McDonald’s legitimate business reasons for not investing more on their channels,” and cited their multiple collaborations with “diverse-owned partners.”

Last May, Allen filed a lawsuit against McDonald’s stating the company does not provide the same treatment for advertisement spending on his platforms as they do with white-owned platforms. According to Black Enterprise, the lawsuit claims McDonald’s only provides $5 million in advertising to black-owned news media entities out of their $1.6 billion budget.

Allen has filed prior lawsuits against multiple corporations for failing to pay an acceptable amount in advertising for Black-owned media companies and settled a $10 billion lawsuit against Charter Communications for a similar issue.
