According to the Daily Mail, 22-year-old James Scurlock was gunned down by a white man who was outside of the Hive Bar on 1207 Harney Street around 11 p.m. Saturday night. Witnesses state the shooter was harassing and taunting protestors while yelling “n****r lover.” Scurlock, who was with his brother at the time of the shooting, jumped on his back to stop him from firing his gun. He was shot two times in the neck and transported to the Nebraska Medical Center where he later died.

The Omaha Police Department said in a statement that the shooter posted earlier on Facebook saying: ‘Just when you think what else could 2020 throw at me? Then you have to pull 48 hours of military-style fire watch.’ His identity was not disclosed to the public.

Police Chief Todd Schmaderer said during a press conference Sunday afternoon that the suspect has been detained and his charges will be filed by the county attorney’s office. No other suspects were arrested.

A GoFundMe page has been set up to help Scurlock’s family pay for funeral expenses.

UPDATE: District Attorney Donald Kleine has released Jacob Gardner after no charges were filed. He called the shooting “senseless yet justified”:

“We know that emotions are running very high…this decision may not be popular and may cause more people to be upset. I would hope that they understand that we’re doing our job to the best of our ability and looking at the evidence and the law. And that’s all we can do. All right, that’s what the basis of this decision was it can’t be based on emotions, it can’t be based on anger, it can’t be based on any of those things. But I would hope that this great community that we live in, will be able to get through this.”
