Woman Sues GEICO After Her Date Gave Her An STD From Hooking Up In His Car

A Kansas woman has filed a $1 million lawsuit against GEICO after she caught an STD from a man whose vehicle was covered by the insurance company.

The lawsuit claims the woman hooked up with a man in the backseat of his 2014 Hyundai Genesis and apparently caught HPV as a result. According to 98.7 KLUV, the woman said they didn’t use protection during the sexual encounter and she feels GEICO owes her money because her date has a policy with the provider. In response to the lawsuit, GEICO has filed a countersuit against the woman and said their policy only covers injuries that occurred out of the ownership, maintenance, or use of the vehicle.

“GEICO alleges that the auto policy only applies to bodily injuries arising “out of the ownership, maintenance or use of the … auto,” and that M.O.’s alleged damages have no nexus to the ownership, maintenance, or covered use of the 2014 Hyundai Genesis. In other words, the vehicle’s covered use did not cause M.O.’s alleged injuries; instead, her injuries arose from an intervening cause—namely, her failure to prevent transmission of STDs by having unprotected sex. Likewise, the umbrella policy does not provide coverage because it only applies if the auto policy provides coverage.”

A judge has yet to make a ruling about the lawsuit but the court does recognize the case and has allowed the defendants “to proceed anonymously until the court rules on M.O.’s motion to dismiss.”
