Tory Lanez and his legal team are now targeting George Gascón, the former Los Angeles District Attorney (DA) in the Megan Thee Stallion shooting case, alleging they found 60 fraudulent errors presented by Gascón. The team also claims that the surgeon who operated on the injured Houston rapper, who also failed to testify during the 2022 trial, is still nowhere to be found.
Tory Lanez Seeking Another Appeal In Megan Thee Stallion Shooting, Plus Pardon Or Clemency From Gavin Newsom
On December 17, Tory Lanez, real name Daystar Peterson, spoke with NBC News, marking his first on-camera broadcast interview since his conviction and 10-year sentencing in the July 2020 shooting of Megan Thee Stallion, born Megan Pete.
Lanez took the interview from inside the California Men’s Colony, a prison in San Luis Obispo. During the broadcast, Lanez revealed that he and his legal team plan to file an appeal with the California Supreme Court.
They also revealed that they are seeking a pardon or clemency from California Governor Gavin Newsom. Lanez’s hopes to either receive a full pardon, expunging his record, or have his sentence commuted. The latter would mean his time served will be enough for release, with his record remaining.
Despite maintaining his innocence in the shooting, a jury convicted Lanez was on three felony charges in December 2022: assault with a semiautomatic handgun, carrying a loaded, unregistered firearm in a vehicle, and discharging a firearm with gross negligence. In August 2023, a judge then sentenced him to 10 years in prison.
Tory Lanez Accuses Prosecutors Of Brady Violation And Withholding Of Critical Evidence
During trial, Lanez and his legal team alleged Megan Thee Stallion’s former best friend, Kelsey Nicole Harris, was the shooter. While continuing to maintain his innocence, Lanez and his legal team told NBC News accused prosecutors of a Brady violation in their new appeal. The rule, established in 1963, requires prosecutors turn over material or potentially favorable information to the defense.
Lanez and his team continued to accuse prosecutors of withholding critical evidence during his trial. They alleged that records used by Megan Thee Stallion in her recent civil defamation lawsuit revealed potential evidence never turned over during Lanez’s trial. The rapper told NBC News:
“I believe not only that I was wrongfully convicted, but the amount of new evidence that has emerged since that trial, I think, has been overwhelming.”
Tory Lanez Targets Former LA D.A. Alleging 60 Fraudulent Errors Found In Megan Thee Stallion’s Medical Records
Nearly a week after Tory Lanez’s first on-camera broadcast since his Megan Thee Stallion shooting conviction, TMZ supports his claims. On Monday (December 22), the publication reported that the rapper’s legal team is going after the former Los Angeles District Attorney over his case.
Lanez’s legal team submitted a new document to the court with testimony from a software expert who reviewed Megan Thee Stallion’s medical records from the night of the 2020 shooting. The expert signed a report claiming former LA DA George Gascón presented 60 fraudulent errors in the medical findings shown during Lanez’s 2022 trial.
Lanez’s legal team notes that the “most alarming” part of the expert’s report reveals a missing document titled “EVIDENCE.” The document reportedly states that a hospital guard named Derek Cervantes bagged, tagged, and transferred “foreign bodies” (i.e. bullet fragments) to the hospital where Megan received treatment for her shooting injury.
During Lanez’s trial, detectives testified that prosecutors gave the medical records to the defense team and that no bullet fragments were recovered from the hospital. However, Lanez’s team said the expert’s report now questions the entire testimony.
TMZ states the report also rings other alarms, like: “altered or overwritten text, QR codes that don’t work, fake signatures, inconsistent document formatting, and missing and repeated pages with date and time contradictions.” The expert also claimed that about 300 pages of information were withheld from Lanez and his attorneys.
Additionally, Lanez’s legal team claims no one can locate Dr. Milton Little, the surgeon who operated on Megan Thee Stallion’s gunshot wounds and failed to testify during the trial. Dr. Little is an orthopedic trauma surgeon at Cedars-Sinai.
