A Tennessee street preacher is suing a school district after his daughter’s teacher kicked her out of class for wearing a T-shirt that says “Homosexuality Is A Sin.”

According to the Daily Mail, the Overton County School District is facing a lawsuit from Richard Penkoski after his 15-year-old daughter was kicked out of class at the Livingston Academy in August. The lawsuit states the school violated his daughter’s right to free speech since she wore a T-shirt with the statement, ‘ Homosexuality Is A Sin-1 Corinthians 6:9-10.’ The lawsuit was filed last week at the US District Court for the Middle District of Tennessee.
The teen was sent to the principal’s office who said she broke the school’s dress code policy for being “sexually connotative.” However, she argued that her classroom displayed the LBGTQ flag and called it a ‘pro-homosexuality’ symbol. Penkoski said the principal explained his daughter’s shirt made a sexual reference and contained the word “sex.”

Penkoski wrote on Twitter that he understands that people support the LBGTQ community and don’t agree with her shirt but understand that she has the right to wear it on Sept. 19.
“There are some educated people who support the lgbt!! While some don’t agree with the shirt my daughter wore they understand she has a constitutional right to wear it. Her rights don’t end where your feelings begin.”
The lawsuit also stated the school district violated the state’s Tennessee’s Religious Freedom Restoration Act.
