As a Texas Supreme Court makes a new ruling, photos surface of Baby Rumi — the child delivered by surrogate McKenna West, who’s been calling him “Gabriel.” As we previously shared, West made headlines as she fled to Texas to “protect” the unborn child, whose parents demanded an abortion.
The biological parents — identified in court documents as Nausheen Gilkar and Omar Ahmed of California — learned the child would immediately be born with a heart defect. Doctors diagnosed the child in utero (at around 20 weeks) with Hypoplastic Left Heart Syndrome (“HLHS”), a serious congenital heart condition that leaves one side of the organ underdeveloped, preventing normal blood flow.
However, it is treatable, which is why the surrogate, who is a single mom from Alaska, fled to Texas. In the state, lawmakers have banned most abortions. West said she drove to Dallas County “for protection,” and to ensure that the baby, “could be near doctors experienced in treating his condition.”
Before West gave birth on August 12, a Texas court ruled that the baby must receive lifesaving treatment upon delivery. The court also issued a restraining order pertaining to the child’s biological parents, making them responsible for the medical decisions within the requirements of the court order. As Baby Rumi underwent life-saving surgeries, his bio parents sued their surrogate for over $100,000 for violating the contract they entered in August 2025.
Texas Supreme Court Rules Baby Delivered By Surrogate McKenna West Can Leave To California With Parents
As of Friday (September 18), the Texas Tribune reports that the state’s Supreme Court ruled in favor of the 1-month-old baby’s parents. He can now leave Dallas to Los Angeles, where the couple lives and will continue treatment. However, West is fighting for him to stay in Texas, where she fights for full custody. The court’s ruling states:
“Sustaining the life of the medically fragile child is the paramount concern in this time-sensitive matter. The limited materials before this Court describe uncontroverted medical testimony of the child’s Texas physician indicating that ‘the child’s best interest in order to preserve the child’s life as long as possible [i]s an ICU-to-ICU transfer.’”
