Parents Of Teen Killed By Driver Distracted By Porn File Lawsuit

Last April near Bear Spring, Texas, 18-year-old Jonathan Weaver was one of three killed in a head-on collision with truck driver James Darling, who was distracted by porn playing on his phone. Now, his parents are filing a lawsuit.

In hopes of sending a message to businesses employing drivers and states lacking enforced handheld/driving laws, the teen’s parents, Patrick and Delena Weaver, are filing a suit against Energy Transfer Partners, the trucking company involved.

Weaver’s mother says, “I am not an angry person by nature, and as time goes on I’m definitely dealing with anger over that, because to me it’s so senseless — watching porn, cellphone use. He killed my son. Please put your phones down. Your life and other people’s lives are valuable. Put the phones away. It can wait.”

Adding to his client’s remarks, the family’s attorney Chip Booker says, “[The incident is] one of the most extreme, egregious cases of distracted driving. Energy Transfer is a billion dollar company that has the resources to monitor and detect this sort of conduct with their drivers.”

Responding to the incident, Energy Transfer Partners states, “Our hearts go out to all those impacted by this tragic accident, however, accident reconstruction analysis suggests that our employee was not at fault. Beyond that, we decline to further discuss specific personnel or pending litigation.”

Returning to April’s incident, paramedics explained that on arrival they recovered the phone of the distracted driver, which was still playing the x-rated movie.

Authorities also state that Weaver’s truck was compressed by almost six feet from the collision.
