Miya Marcano’s Family Files Wrongful Death Lawsuit Against Apartment Complex
The family of 19-year-old Miya Marcano has filed a wrongful death lawsuit against her apartment complex after the young woman was found murdered in a wooded area.
“At all material times, through its agents and/or employees, Arden Villas owed a nondelegable duty to its residents and invitees, to exercise reasonable and ordinary care to maintain the Arden Villas, in a condition reasonably safe for use by its residents and invitees,” the lawsuit stated.
In addition, the suite notes that the apartment complex did not take the necessary safety measures to prevent “foreseeable criminal attacks, especially by employees”. As well as failing to notify residents that employees still have key fob access to their apartments for access at any time.
Marcano’s family also called out the local police for not acting quickly enough upon the disappearance of their loved one.
“The incident report lacks critical details,” Marcano family attorney Daryl Washington said. “What we do know is that critical hours were lost and if it hadn’t been for this family’s strength and determination, we may still be searching for Miya.”
