In July 2025, we first learned of the passing of the beloved actor. His cause of death was confirmed as asphyxia after an accidental drowning on July 20, 2025. The 54-year-old ‘Cosby Show’ actor was on vacation with his family at Playa Cocles. It’s a beach near Limón on the Caribbean coast of Costa Rica.
Malcolm was swimming in the ocean with his daughter when a strong rip current caught them and pulled them deeper into the water. Nearby surfers rushed to save them. One surfer rescued the daughter safely. However, the actor was pulled to shore, given CPR for 45 minutes, but could not be revived.
A year after Malcolm’s passing, his widow, Dr. Tenisha Delilah Warner, 48, filed a lawsuit against her mother-in-law, Pamela Warner, who is named successor trustee of the Warner Family Trust. In the filing, Tenisha said she signed a prenup and in it, Malcolm promised her several financial benefits.
According to Tenisha, Malcolm agreed to pay her $16,000 tax-free each year on their wedding anniversary, fund her Roth IRA for as long as they remained married, and pay her $5,000 a month for working as his Chief of Staff and assistant. She said it also included a $1 million life insurance policy.

However, due to Malcolm’s sudden passing, she was never transferred the funds. So, she claims she is owed at least $1.2 million. In her lawsuit, he asked a court to pay her from the family trust, believing Malcolm’s estate does not have enough assets to cover the alleged debt. However, his mother, Pamela, is in charge of managing the trust, and she was his longtime business manger.
Tenisha argued that while she fulfilled her duties in the prenup, she now needs the court’s help in making sure the money promised to her and her daughter is paid out. Tenisha later spoke out and said:
“For the last year, I have attempted to privately settle my beloved husband’s complicated estate and honor his last wishes. Malcolm had every intention to provide for our 9-year-old daughter and me. He was close to finalizing a new estate plan to replace the stale plan created in 1996 when he was 26 years old, 20 years before we met and well before we gave birth to our beautiful daughter. Sadly, he was unable to do so before we lost him. I have been struggling to care for our daughter as a single mom and now as her sole provider. Legally, I had no choice but to take action to protect our rights before any potential statute of limitations expired. We thank you for your support, love, and understanding as we work through this painful process while honoring Malcolm’s life on the first anniversary of his death.”

Malcolm-Jamal Warner’s Mother Settles With Daughter’s Court-Appointed Guardian As Widow Continues With Lawsuit
In August, about a month later, TMZ reported that Pamela reached a settlement with his daughter’s guardians. Pamela told the outlet that she worked out a deal so that his daughter will inherit a portion of his fortune.
Then in early September, TMZ reported that Pamela again spoke with them about looking to settle with Tenisha. She claimed she proposed a one-time payment and give the rest to MacKenzie. This included a $2 million life insurance policy, a separate trust in Georgia Malcolm used to purchase a home for his wife and daughter, and a retirement plan left to Tenisha worth $2.4 million. Pamela said Tenisha declined the offer and continued with her lawsuit. However, Pamela settled directly with MacKenzie’s court-appointed guardian.
A few days later, TMZ reported that Tenisha alleged Pamela sold off the actor’s Studio City, California home for $1.6 million. Tenisha said the family home was meant her and their daughter and that Pamela sold it and put the earnings in the trust.
Tenisha also denied Pamela’s claims about refusing to settle in the estate battle. She admitted Pamela offered her and her daughter a Georgia home. However, she said it has a $700,000 mortgage. She also said it doesn’t suffice as a substitute for providing for MacKenzie from Malcom’s estate. A week later, TMZ has reported that Pamela alleges Tenisha “terminated” her relationship with MacKenzie after Malcolm’s death.
