Rittenhouse is accused of shooting three demonstrators, killing two of them, during a night of unrest that erupted in Kenosha after a police officer shot Jacob Blake seven times in the back while being arrested in August 2020. Rittenhouse, from Antioch, Illinois, was 17 at the time of the shooting and armed with an assault rifle. He faces counts of felony homicide and felony attempted homicide. Judge Bruce Schroeder explained that it was unclear whether the rifle Rittenhouse used qualified under the Wisconsin statute. The dispute over Rittenhouse’s gun centered on whether the length of weapon qualified it as dangerous under the state law. Schroeder had earlier dismissed the defense’s effort to get the charge thrown out, but on Monday said that he believed the statute was poorly written and was open to challenging the count. The prosecutors in the case chose not to press their case on the single misdemeanor count.

Despite this, Rittenhouse is still facing multiple felony counts, including two counts of homicide. Jury deliberations could begin as early as Monday afternoon.
