A Turkish woman reportedly filed for divorce, claiming her husband didn’t keep up with his hygiene. The woman, identified as AY, said her husband, CY, did not take regular showers, wore the same clothes for extended periods, and neglected oral hygiene by brushing his teeth only once or twice a week. AY presented witnesses in court who confirmed these allegations against her husband.

According to Sabah, a Turkish news outlet, the 19th Family Court found CY to be entirely at fault and granted the divorce, awarding AY a compensation of 500 thousand liras(16,419.12 USD). The decision was deemed lawful by the Regional Court of Justice in Ankara and was subsequently approved by the 2nd Chamber of the Supreme Court of Appeals, making it final. The Supreme Court ruled that the defendant’s husband was entirely responsible for the circumstances that led to the divorce, such as his lack of personal hygiene and body odor, while the wife was not at fault.

AY’s lawyer, Senem Yılmazel, also upheld the compensation decision. Yılmazel stated that under civil law, reasons for divorce are categorized as either special or general. General reasons encompass all factors that make shared life unbearable. In this case, the reason for divorce was the defendant’s disregard for personal hygiene, including infrequent showering and irregular teeth brushing. The court found the defendant entirely at fault and the plaintiff partially at fault. A compensation claim was filed, resulting in the court awarding the money to AY.

Higher courts then reviewed the decision, first the Regional Court of Justice and finally the Supreme Court of Appeals, which confirmed its validity. Lawyer Yılmazel emphasized that witness testimonies substantiated AY’s allegations. Mutual friends of the couple and colleagues from the defendant’s workplace provided statements attesting to the defendant’s body odor and habit of wearing the same clothes for consecutive days. These witness statements played a crucial role in proving the case. Yılmazel stressed that spouses have a responsibility to maintain a shared life, and if certain behaviors make that life unbearable, the other party has the right to seek a divorce. Such situations are difficult for anyone to tolerate except the spouse involved. Yılmazel concluded by emphasizing the importance of being mindful of behavior and cleanliness in all human relationships.
