Halle Berry is denying her ex-husband Olivier Martinez’s allegations as a judge grants him a temporary restraining order and temporary custody of their 12-year-old son.

As we previously shared, Martinez filed for a TRO against the actress alleging she physically abused their son, Maceo-Robert Martinez, last weekend. According to TMZ, Martinez claimed Berry jumped on their son, put her hands around his neck, and choked him during an alleged incident on Saturday (September 26).

Martinez claimed his son called him after and alleged his mother physically attacked him and placed him in a chokehold. He also alleged this wasn’t the first incident of its kind and that it followed other attacks.

Furthermore, Martinez claimed the alleged incident happened at home, with her boyfriend Van Hunt present. Martinez alleged Maceo was in his room playing a VR game with goggles when Berry entered in a rage and said he “looks so stupid” and is “such an idiot.” Berry allegedly jumped on Maceo and fought him.

Olivier Martinez Accuses Halle Berry Of Abusing 12-Year-Old Son While Filing For Restraining Order And Primary Custody, She Denies Claims

Martinez continued to allege Berry threatened to have him deported to France and asked their son what he’d do “as a Black man” to protect her from being robbed by his father, whom she allegedly called “a white b*tch.”

In his restraining order request, Martinez asked a court to for sole custody of their son and to bar Berry from reaching both of them. Berry allegedly texted Martinez the next day writing “I feel terrible about what happened last night as I know he does as well.”

Within hours of the breaking report, a Los Angeles County judge granted Martinez’s request for a temporary restraining order against Berry. It required Berry to stay 100 yards from Martinez. The filing allowed her to see their child, but only during court-ordered visitation, two days a week and every other weekend. This is until a hearing on October 16.

In response to Martinez’s claims, Berry and his legal team released a statement:

“To say this filing is entirely meritless and deliberately misleading would be an understatement. There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo- misconduct for which Mr. Martinez has already been legally sanctioned. In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behavior. Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”
