The man who was photographed sitting at Nancy Pelosi’s desk during the Capitol riots could possibly face 10 years in prison.

Richard Barnett appeared in federal court Tuesday after reporting himself to authorities last week for participating in the raid. He was charged with carrying a lethal weapon in a restricted area after prosecutors revealed that Barnett allegedly carried a stun gun during the siege on the Capitol. The federal charge means Barnett could face the maximum sentence of 10 years and a $250,000 fine.

The Arkansas resident became viral after he was pictured sitting at Pelosi’s desk with his feet up and left a note that said “WE WILL NOT BACK DOWN.”

Barnett’s previous charges were violent entry and disorderly conduct on Capitol grounds, theft of public money, property, or records. As reported by MSN, the penalties for these charges are up to almost two years in prison and more than $100,000 in fines.

He is expected to appear in court for a bond hearing on Friday.
