Tory Lanez’s attorneys are pushing for the rapper to be released on probation and to be placed in a substance abuse program, according to reporter Meghann Cuniff.
On Wednesday (Aug. 2), Tory Lanez’s legal team filed a sentencing memo in Los Angeles Superior Court ahead of his sentencing on August 7th and looks like there requesting for him to be free man. “I have Tory Lanez’s sentencing memo for shooting Megan Thee Stallion, Cuniff tweeted on Wednesday. “It asks that he be released from jail to probation and a substance abuse program.”
As we previously reported, prosecutors are looking to get Lanez to serve at least 13 years for the shooting of Megan Thee Stallion even though Tory and his team are still claiming he’s innocent. Prosecutors filed a memo on June 6 stating that any sentence less than 13 years for Lanez would not only “endanger public safety,” but “not be in the interest of justice,” according to a report from Billboard.
“The defendant actively invited harassment of the victim by spreading misinformation to his large following in an effort to galvanize the public against the victim and even the prosecution team without any regard to the dangers it posed,” prosecutors wrote in the memorandum. “The defendant has weaponized misinformation to his large following to such a degree that it has left a lasting traumatic impact on the victim.”
Tory lanez and his team also filed a motion to disqualify Judge David Herriford. Claiming the Los Angeles County Superior Court judge has shown favoritism to the prosecution.
“Conversely, the judge gave the People a full and fair opportunity to present argument uninterrupted, even when the case cited by the People did not stand for the proposition that they advanced,” the defense attorneys wrote in their filing.
They continued: “Together, these facts reveal such a high degree of favoritism or antagonism as to make fair judgment impossible. Given these facts, a reasonable person would fairly entertain doubts concerning the judge’s impartiality. As a result, disqualification is required.”
Herriford previously responded to Tory’s claims when he filed a motion for a new trial, which was denied. “I am not prejudiced or biased against or in favor of any party to this proceeding or their counsel,” he wrote at the time. “All rulings made by me in this action have been based upon facts and arguments officially presented to me and upon my understanding of the law. … All statements made by me and all actions taken by me in this proceeding have been done in furtherance of what I believe were my judicial duties.”
