Judge Jeffrey Brown said a statement that the executive order “amounts to a presidential mandate that all federal employees consent to vaccination against COVID-19 or lose their jobs. Because the President’s authority is not that broad, the court will enjoin the second order’s enforcement.” According to the New York Post, Brown added that the Biden Administration’s vaccine mandate for federal workers was going too far in reference to making them undergo “a medical procedure as a condition of their employment.”
The Department of Justice has appealed against Brown’s ruling and sent a request to the US Court of Appeals for the Fifth Circuit.

President Biden originally announced the mandate last September and said federal employees needed to be vaccinated or be fired from their positions. The deadline for the mandate was set for November 22. Additionally, there was no option for employees to have weekly testing for COVID-19 if they opted out of receiving the vaccine.
