The Johnson County District Attorney’s Office is moving to dismiss charges against Jackson Mahomes.
In a new motion that was filed on Tuesday, it reads that the victim in the case has avoided being served with a subpoena to show up to court. “The State is not seeking a continuance to continue to serve when she has made her lack of cooperation abundantly clear,” according to the prosecution’s motion.

According to KSHB, the victim also signed an affidavit in late November 2023 in which she stated she “never contacted law enforcement when the alleged acts occurred.” It adds, “I do not want to cooperate with the State in prosecuting the matter and wish the matter to be dismissed as to anything involving me,” the affidavit stated.
The woman, Aspen Vaughn, is the owner of Aspens Restaurant and Lounge, previously did an interview and revealed that she was receiving death threats since coming forward.
“I feel like definitely, since it’s occurred, my safety is definitely at risk,” Vaughn said. “I’m feeling attacked by people I’ve never met. Why do victims not come forward? It’s because this is how they get treated,” she stated.
As we previously reported, Mahomes was arrested on three counts of aggravated sexual battery (class A felony) and one count of battery in connection to the incident at the restaurant that night. Mahomes was taken into custody at 7:00 a.m., and booked into Johnson County Jail 40 minutes later on a $100,000 bond. The social media personality is accused of shoving a 19-year-old male waiter multiple times and later forcibly kissing the 40-year-old female owner of Aspens Restaurant and Lounge in Overland Park on February 25th.

“He forcibly kissed me out of nowhere and I’m telling him, pushing him off saying ‘what are you doing?’ and then he proceeded to do it two more times where the last time I was pushing him off and I can see on the cameras that somebody was outside the office door and I was yelling for them to come help because he’s big and massive,” Vaughn said via the Kansas City Star.
Mahomes’, attorney Brandan Davies previously spoke out and said his client did nothing wrong despite being seen on camera.
“Our investigation has revealed substantial evidence refuting the claims of Jackson’s accuser including the statements of several witnesses. We have reached out to law enforcement to provide the fruit of our investigation so that they may have a complete picture of the matter.”
