Philadelphia District Attorney Larry Krasner has filed a lawsuit against Elon Musk and his pro-Trump organization, America PAC, in an attempt to stop Musk’s controversial $1 million donation campaign aimed at registered voters.

“America PAC and Musk are lulling Philadelphia citizens—and others in the Commonwealth (and other swing states in the upcoming election)—to give up their personal identifying information and make a political pledge in exchange for the chance to win $1 million,” the lawsuit alleges. “That is a lottery.”

According to multiple news outlets, on October 19, Musk and America PAC initiated a daily giveaway of $1 million aimed at voters in specific swing states. Participants are required to provide personal identification details, including their cell phone number and address, as well as to sign a petition affirming their support for the Constitution and the right to bear arms. Those who comply become eligible for a “random” chance to win the $1 million prize.

In the lawsuit, Krasner and his team contended that all lotteries should be conducted and managed by the state. They also claim that the initiative breaches the state’s consumer protection regulations by “deploying deceptive, vague or misleading statements that create a likelihood of confusion or misunderstanding.”

Musk has contributed several million dollars to America PAC, which was established earlier this spring to assist the Trump campaign in registering and mobilizing voters in crucial battleground states. Notable supporters also include Joe Lonsdale and the Winklevoss twins, Cameron and Tyler. Musk seems to have integrated himself into the Trump campaign, having attended and spoken at the former president’s rallies on two occasions, while also promoting anti-Kamala Harris messages on social media.

The lawsuit demands that Musk and his super PAC put an immediate halt to the giveaways.

“Running an illegal lottery and violating consumer protections is ample basis for an injunction and concluding that America PAC and Musk must be stopped, immediately, before the upcoming Presidential Election on November 5,” the complaint said.
