Although the actress was officially declared brain-dead on Friday, California law states a person is legally dead after the declaration even if they have a heartbeat. According to her rep, Heche recently planned to donate her organs in case of her death. “It has long been her choice to donate her organs. [She] is being kept on life support to determine if any are viable,” they explained in a statement to Page Six last week.

As previously reported, Heche suffered an anoxic brain injury from the crash. Due to the severity of her condition, she was not expected to survive.

A new video surfaced of the actress bursting out of a burn bag after authorities claimed she was unresponsive after the crash.

After the news of her death, Heche’s oldest son, Homer Lafoon,20, released a statement and said he hoped she reached “eternal peace.”

“My brother Atlas and I lost our Mom. After six days of almost unbelievable emotional swings, I am left with a deep, wordless sadness. Hopefully, my mom is free from pain and beginning to explore what I like to imagine as her eternal freedom.”

The family also released a joint statement and thanked fans for their good wishes and support.

We have lost a bright light, a kind and most joyful soul, a loving mother, and a loyal friend. Anne will be deeply missed but she lives on through her beautiful sons, her iconic body of work, and her passionate advocacy. Her bravery for always standing in her truth, spreading her message of love and acceptance, will continue to have a lasting impact.”

A blood test revealed that she had cocaine and fentanyl in her system, but the Post said the fentanyl was most likely used for her treatment during her time at the hospital.

Heche is well known for her roles in “Donnie Brasco,” “Volcano,” ‘I Know What You Did Last Summer,” “John Q,” and “Psycho.” She also co-starred in the HBO series “Hung.” She had upcoming projects for Lifetime and HBO.

The Los Angeles Police Department said in a statement that they would conclude its investigation due to the actress’s death.

“As of today, there will be no further investigative efforts made in this case. Any information or records that have been requested prior to this turn of events will still be collected as they arrive as a matter of formalities and included in the overall case. When a person suspected of a crime expires, we do not present for filing consideration.”
