Michigan Woman Sues Monster Energy After Finding Dead Mouse in Can

A Michigan woman says she experienced a real-life nightmare after finishing a can of Monster Energy—only to find a dead mouse sitting at the bottom. Now, she’s taking the energy drink giant to federal court.

According to Detroit News, McKenzie Cain initially filed a complaint in state court back in September 2024, but the case has since been transferred to federal court in the Western District of Michigan. The lawsuit accuses Monster Energy of failing to properly inspect and ensure the safety of their product before it hit store shelves.

Cain said she purchased the can of Monster at Big Apple Bagels in Grand Rapids this past April, and although she noticed something was off, she didn’t expect anything this extreme. “It felt a little heavy, but I didn’t think too much of it,” she allegedly told her legal team. But when she finished the drink and looked inside the can, she saw what no one ever expects to see: a dead rodent floating at the bottom.

Cain’s lawyer, Zachary T. Runyan, isn’t holding back. He told the press:

“Mice, like all rodents, often carry diseases that can be extremely harmful. It goes without saying that no beverages should ever make it to the shelf with a dead animal inside it.”

The lawsuit is built on the claim that this was a breach of the implied warranty of merchantability. It alleges that Monster Energy was negligent in ensuring quality control, putting customers like Cain at serious health risk. The suit also includes claims of emotional distress, trauma, and physical illness following the incident.

Cain says she became sick shortly after consuming the drink and continues to deal with lingering effects tied to the trauma. The lawsuit claims that Monster should be held liable for all damages and injuries resulting from the contaminated product.
