A Tennessee man is accused of murdering a 4-month-old little boy after discovering the baby was not his.

WREG reports that Jose Avila-Agurcia, 33, is facing charges of first-degree murder for beating Alexander Lizondro-Chacon to death.

Police are said to have responded to a home on Court Avenue where they discovered the child’s mother, Mercy Lizondro-Chacon. She revealed that her son was having issues breathing and tried to administer CPR.

The young child was then rushed to a hospital where he was pronounced dead due to a blunt force trauma to the head. Medical reports also show that the child had pneumonia, along with a fractured skull and ribs.

Avila-Agurcia became a suspect after the boy’s mother told the police that he admitted to hitting the baby numerous times in the head after finding out he was not the dad. He claims he believed the baby was his until after his birth. The Shelby County medical examiner has ruled the death as a homicide.

Avila-Agurcia is currently in prison with no bond.
