A judge has granted workers’ compensation for a man who fell down the stairs in his apartment and injured his back while working from home.

The man reportedly broke his back after walking down his spiral staircase from his bedroom to the computer. Since he was working from home, the worker filed it as a workplace incident but it was denied by his company’s insurance company. He eventually brought the issue to court and it was ruled that he should be entitled to worker’s comp. due to his “commute” from his bed to the computer.
“The plaintiff suffered an accident at work when he fell on the way to his home office in the morning. According to the binding findings of the lower instance, walking the stairs to the home office was only used to start work for the first time and is therefore insured as a service in the interests of the employer.”

During his argument, the man said due to the pandemic, many people were working from home and that the incident should’ve been covered by his employer.
With regard to the protection provided by the statutory accident insurance, these should not be worse off than the employees in the company. The way to start working in the home office in the private apartment must therefore be an insured company route.”
