Kevin Perez aka Kay Flock was taken into custody after self-surrendering to detectives at the 30th Precinct as reported by XXL. He was arrested and charged with murder and criminal possession of a weapon for the shooting death of 24-year-old Oscar Hernandez. Hernandez was killed on Dec. 16 during a dispute that took place at a barbershop on Amsterdam Ave. and W. 151 Street.

Hernandez was waiting for a haircut before 10 a.m. and Kay Flock allegedly opened the door and asked him what was he looking at. The two men took the dispute outside and started arguing when Kay Flock allegedly pulled out a gun and shot Hernandez in the neck and back.

The victim’s family believes the shooting could’ve been a case of mistaken identity despite NYPD claims that the shooting was gang-related.

Kay Flock’s attorney also released a statement regarding the arrest and said they have conducted their own investigation as per the media outlet.

“We have begun our own investigation into these allegations. More importantly, considering the DA’s significant disclosure this morning that the NYPD received a tip saying someone else is the shooter, we demanded the DA’s office provide prompt disclosure of the videos referenced in the complaint and more information on the tip.”
