A San Francisco court has ordered a Black landlord to forfeit her $4 million dollar building to a white tenant after a long battle in court.

The decision comes after Anne Kihagi evicted the tenant from the unit after acquiring the building for $2.6 million in 2014. In 2016, Kihagi decided to help her younger sister by giving her one of the units in the building along with refurbishing the building to increase its value. San Francisco law states that a landlord can recover possession of a rented apartment for the owner or owner’s relative to live in and has the right to kick out any tenants at any time based on this law.

However, in 2015, City Attorney Dennis Herrera teamed up with the other tenants in the building in order to remove Kihagi and her sister’s family. They claimed in court that Kihagi’s sister never moved in despite documentation stating otherwise and convinced an all-white jury that the tenant’s eviction was an act of malignancy.

The tenant will now receive the entire six-unit building and will receive income through rent payments. Kihagi also offered to buy a $800,000 condo but the court decided to award the building instead.

The case is currently being appealed. Let us know your thoughts below.
