Jamie Foxx Demands For Sexual Assault Lawsuit To Be Dismissed — Claims Whatever Occurred Was Consensual

Jamie Foxx has requested that the court dismiss the lawsuit filed against him by an individual alleging sexual assault in connection with an incident on a rooftop in New York City, according to an exclusive report by In Touch.

Court filings obtained by the news outlet indicate that the 56-year-old actor contends that any interactions he had with the woman, identified in the lawsuit as Jane Doe, were consensual in nature. His lawyer stated, “To the extent [Jamie] engaged in any conduct as alleged in [Doe’s] [lawsuit], [Doe] consented to those acts.” Jamie’s lawyer added that “to the extent [Jamie] engaged in any conduct as alleged” in the lawsuit “such conduct presented no serious risk of physical injury to [Doe].”

Furthermore, Jamie noted that the woman previously filed a nearly identical lawsuit in 2020, which was ultimately dismissed by the court. He stated that if Jane Doe experienced any harm, it was not a result of his actions. “[Doe] waived the right to pursue her claims by reason of her own actions and course of conduct,” his lawyer added. 

Jamie requested that the entire lawsuit be thrown out and sought reimbursement for his legal expenses.

In her complaint, Doe alleged that she encountered Jamie at Catch NYC & Roof in August 2015. She stated that her friend approached the star to ask if he would pose for a picture with her. Doe claimed that she thought Jamie appeared to be under the influence during the incident.

In her lawsuit, Doe stated that Jamie led her to a secluded section of the club’s rooftop. She claimed that he placed his hands on her waist and beneath her clothing, eventually moving them toward her breasts before inserting his fingers into her vagina and anus. According to Doe, Jamie ceased his actions when her friend appeared around the corner. The lawsuit seeks unspecified damages for the purported pain, suffering, and emotional distress she experienced as a result of Jamie’s actions.

Following the filing of the lawsuit, Jamie refuted the allegations through a statement issued by his representative.

The spokesperson said, “The alleged incident never happened. In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter. The claims are no more viable today than they were then.”
