Harvey Weinstein To Be Arraigned For Dismissed Sexual Assault Charge

Harvey Weinstein will appear for arraignment in Los Angeles on Monday for a previously dismissed sexual assault charge.

He faces a reinstated charge of sexual battery for allegedly attacking a woman in 2010 and he currently faces 11 charges of rape and sexual assault from five victims as reported by the New York Post. Last month, Weinstein was extradited from the Wende Correctional Facility in New York to California. He also pleaded not guilty to the charges of rape and battery.

Initially, Los Angeles Superior Court Judge Lisa B. Bench held the defense’s challenge to the sexual assault count on July 29. However, she permitted the prosecution to seek after a grand jury indictment to amend Weinstein’s dismissed charge.

Weinstein’s lawyer said in a statement that the prosecution “cannot breathe life into a charge that’s already barred by the statute of limitations.” As reported by NBC Los Angeles, the defense tried to challenge two other counts where Weinstein allegedly forced oral sex and forcible rape towards a victim between September 2004 and September 2005.

If he’s convicted for all charges, he will face a maximum of 140 years in prison and will serve his sentence in New York.
