Gunna & His Legal Team File 4th Motion For ‘Reasonable Bond’ In Atlanta RICO Case

According to new reports, Atlanta rapper Gunna and his legal team have now filed a fourth motion for “reasonable bond” in his RICO case.

Just a few days ago, Gunna, full name Sergio Kitchens, was denied bond for release in his case. His legal team called it “a miscarriage of justice.”

His team is has now filed a fourth motion as reported by WSB-TV reporter Michael Seiden. Via his Twitter, Seiden said, “Gunna’s defense claims prosecutors have made proffers at hearings that turned out to be false and/or misleading, according to the motion.”

Gunna’s legal team wrote in their motion, “Despite the evidence and proffers offered by the defense that demonstrate beyond question that the prosecution’s tentative proffers and predictions are inaccurate, the Court has repeatedly denied bond with no finding of fact relating to why the State’s ‘evidence’ upon which it has relied satisfied the State’s burden of persuasion under the preponderance standard of proof.”

Seiden added in a follow-up tweet, “Kitchens respectfully demands the truth to be told, for his continued pretrial detention based on lies and misrepresentations constitutes a miscarriage of justice.”

Gunna’s latest motion for bond arrives just days after his third motion was denied, which prompted a response from personality-turned-legal student Kim Kardashian.

Kim took to her Instagram Story and wrote, “Imagine sitting in a cell for 155 days without any obligations. Since your only guiding evidence is a ticket for irrelevant window film and someone says you’re not in the gang.

That’s where my friend Sergio found himself today after being denied his bond for the third time, although there is no evidence that he had committed a crime.

Earlier this year I had the pleasure of meeting Sergio aka Gunna. He appreciated my interest in criminal justice reform and asked me to take a look at his cousin’s case.

Since his incarceration, I have worked with his legal team and the facts of his case are yet another example of why the ‘justice system’ is anything but just.

Kim went on to include some facts about the Atlanta rapper’s case:

“*Prosecutors alleged witness intimidation yet not a single person has said he threatened them or had anyone else threaten them.

*Prosecutors alleged he’d had a nurse sneak him drugs yet the nurse says this is untrue and there is zero evidence it happened.

*Prosecutors alleged he was in a gang based on a witnesses testimony, but when you read that testimony it says specifically that he is not in a gang and the witness doesn’t really know him and the interview is 3 years old.”

Kim concluded:

“Even though there is no evidence tying him to a single crime, or showing that he is a risk to the community, Sergio had his bond denied once again today. His trial is set for January but will likely be continued meaning he will sit in jail even longer. Sergio deserves better and we all should demand better. #FreeGunna.”
