The Florida boy caught on camera viciously assaulting a nine-year-old girl on a school bus is charged with battery.

After the victim’s mother filed criminal charges for the vicious assault last week, officials announced Tuesday that the boy was charged with battery. As previously reported, a third-grade Coconut Palm K-9 Academy student was attacked by two boys on a bus ride after allegedly arguing with a 15-year-old boy. The school’s police officer issued him a civil citation after the video went viral on social media. Nonetheless, Miami-Dade State Attorney Katherine Fernandez Rundle ruled that it was insufficient punishment for his actions.

‘We believe that, based on the evidence and the circumstances, the use of a civil citation was incompatible with the level of violence displayed by the 15-year-old against his much younger and smaller victim. As a result, we have filed criminal battery charges with our juvenile courts.’

The victim’s mother, Jenni, released images of her daughter’s injuries and the school experiences violence on campus. Additionally, she wants to transfer her three children to another school amid the incident. Her son was also attacked during the assault, telling Local 10 News that it happened out of nowhere and hopes the charges will help rehabilitate the teen.

‘I’m just hoping that he received the rehabilitation that he needs. The amount of aggression he did toward my daughter, I thought, was unnecessary. This needs to be taken care of right away. Our children are in danger at school, where we are trusting other people to do their jobs. That’s not justifiable. It doesn’t matter what was said. Our kids need to learn that through violence, nothing is resolved.’

Jenni adds that she doesn’t want to incriminate any children but wants the school to be a safe space for all children to prevent future incidents like this. The Miami-Dade School Police said in a statement that they also checked the victim and her brother for injuries and released them to their parents. According to the Daily Mail, Jenni said the school is also dealing with overcrowding which can lead to incidents similar to what happened to her daughter.

‘All ages are on that bus, and it’s overfilled. It’s very crazy because there’s all this yelling in the bus, and the two adults on the bus – the bus (driver) and the bus aide, only sit in the front. We’ve had issues with my son and the kids on the bus, in the cafeteria, and at dismissal. I already drew the line, and I was also on the phone with the district — I spoke with someone from the district — and the only thing they could advise me of was to continue to speak with the principal and pull up a bully report. You’re taking care of our children — you’re still responsible for them. That’s what you have a job for.
