Federal Judge Tosses Jussie Smollett’s Lawsuit Against Chicago

Looks like Jussie Smollett just can’t catch a break. On Wednesday, a federal judge decided to toss the lawsuit filed by the actor against the city.

As we previously reported, Smollett claimed he was attacked by two men in January of last year. Following an investigation, he was charged with making a false report. Those charges were subsequently dropped with little explanation from prosecutors. In April of 2019, the city sued the “Empire” star seeking reimbursement of more than $130,000 paid in overtime to police officers who were involved the investigation of the alleged homophobic and attack on Smollett.

However, he countersued in November, saying he had been the victim of a malicious prosecution that caused him humiliation and extreme distress. Despite all that, U.S. District Court Judge Virginia Kendall ruled that the “Empire” actor’s claim of malicious prosecution cannot move forward.

Kendall said the Chicago Police Department’s motive was bringing Smollett to justice ”for a crime it had probable cause to think he committed.”
