A Barack Obama-appointed federal judge has ordered the Donald Trump administration to bring back the Maryland father they mistakenly deported to an El Salvador mega prison.
As we previously shared, On March 12, 29-year-old Kilmar Armando Abrego Garcia was pulled over in an IKEA parking lot and arrested. Abrego Garcia had his 5-year-old son in the car with him as well.
In court documents, Abrego Garcia’s wife, Jennifer Vasquez Sura, said their son misses his father badly. She said, “He shows me how much he missed Kilmar. He has been finding Kilmar’s work shirts and smelling them, to smell Kilmar’s familiar scent.” Vasquez Sura identified her husband in a photo of detainees entering intake at CECOT, El Salvador’s notorious mega prison.
According to CNN, in 2019, an immigration judge granted Abrego Garcia protection against deportation back to El Salvador. Although he entered the U.S. illegally from El Salvador around 2011, Abrego Garcia’s attorneys said he fled his homeland due to gang violence over a decade ago. Now back in his native land, he faces persecution by local gangs.
Despite having protection by a previous immigration judge’s order, the Immigration and Customs Enforcement agency (ICE) under Donald Trump sent the Maryland father back to his native El Salvador on March 15. On March 31, Donald Trump’s administration finally acknowledged their mistake, calling the incident an “oversight” and “administrative error.”

Despite this, however, White House officials have argued against requesting his return. They claim they need proof showing that he does not have ties to the MS-13 gang. Additionally, Trump’s administration claims they do not have the power to request a return from El Salvador’s government. At best, they claim they can only order the White House to “entreat or even cajole, a close ally.”
Now, on Friday (April 4), a Barack Obama-appointed federal judge ruled that Trump’s administration must return the Maryland father they mistakenly deported to El Salvador. U.S. District Judge Paula Xinis, of Maryland,said, “This was an illegal act,” and ordered the U.S. to return the father by 11:59 p.m. on Monday, April 7. The judge said according to the terms of the agreement between the U.S. and El Salvador, it is believed that Abrego Garcia can be returned.
