The request was filed on Friday where Trump asked a judge to issue a preliminary injunction to have his Twitter account restored as part of his lawsuit against the company. His complaint states Twitter is “censoring” his freedom of speech and labeling his tweets as “misleading information.” Additionally, it claims Twitter was  “coerced by members of the United States Congress” to permanently ban his account.

“On January 8, 2021, Defendant indefinitely banned Plaintiff from its platform, a major avenue of public discourse. Defendant’s censorship and prior restraint of Plaintiff’s speech violates the First Amendment to the United States Constitution and likewise violates Florida’s newly enacted Stop Social Media Censorship Act (“SSMCA”). Defendant exercises a degree of power and control over political discourse in this country that is immeasurable, historically unprecedented, and profoundly dangerous to open democratic debate.”

Trump filed several class-action lawsuits back in July against Twitter, Facebook, and Google along with their chief executives for permanently banning his accounts. The lawsuit argues that the companies violated his First Amendment rights dispute the amendment is referencing censorship by the government, not private companies.
