Former president Donald Trump will be arrested on Tuesday but not be placed in handcuffs or subjected to a mugshot.

An arrest report from the NYPD revealed Trump was informed that he had been charged with 34 felony counts for falsification of business records and that his charges would be entered into the court system. A close source told Yahoo! News that he will be put in handcuffs, placed in a jail cell, or be photographed for a mugshot until a judge has deliberated on pretrial conditions.
Manhattan District Attorney Alvin Bragg’s office reportedly consulted with the Secret Service and New York City court officials. It concluded Trump would not be handcuffed because he doesn’t post as a flight risk or threat to the district attorney. The charges against Trump can be prosecuted in New York as a misdemeanor, but Bragg’s office moved all the charges to Class E felonies.

In New York State, a Class E felony is a type of felony offense that is considered less serious than Class A, B, C, or D felonies but more serious than Class F or Class G felonies.
Examples of Class E felony offenses in New York City include:
- Aggravated harassment
- Criminal possession of a weapon in the third degree
- Grand larceny in the third degree
- Identity theft in the first degree
- Unauthorized use of a vehicle in the first degree
- Vehicular assault in the second degree
The penalty for a Class E felony in New York City can include a term of imprisonment of up to four years, a fine of up to $5,000, or both. The specific sentence will depend on a variety of factors, including the nature of the offense and the defendant’s prior criminal history.
However, the evidence for the crime that increased Trump’s alleged misdemeanors to felonies is currently unclear and will not be revealed until the indictment is unsealed on Tuesday. A spokesperson for Trump told the outlet that his legal team did not see the indictment or been briefed on the details.
“Wow! District Attorney Bragg just illegally LEAKED the various points, and complete information, on the pathetic Indictment against me,” Trump wrote on his social media platform Truth Social.
