Donald Trump Administration Claims Haiti No Longer Meets Requirements For Temporary Protected Status, 350,000 Haitian Migrants Set To Lose Legal Status On February 3, 2026

President Donald Trump claims Haiti no longer meets the requirements for Temporary Protected Status (TPS), therefore, the program will end in February 2026. According to CBS News, the move leaves at least 352,959 Haitian migrants affected.

On Wednesday (November 26), the Trump administration announced the termination of TPS. The policy allowed for beneficiaries to work and live in the United States without fear of deportation for specific timelines outlined by the Department of Homeland Security (DHS).

Under the Joe Biden administration, officials massively expanded the TPS policy. Under it, protections went out to hundreds of thousands of incoming migrants from Afghanistan, Haiti, Ukraine, Venezuela, and more. Both legal and illegal immigrants benefited from the policy.

Now, the Donald Trump administration is closing up the program and leaving hundreds of thousands of Haitian migrants affected. The administration claims they will all be eligible for deportation on February 3, 2026, unless they implement other legal means to remain in the United States.

According to the USCIS (United States Citizenship and Immigration Services) website, the Department of Homeland Security Secretary Kristi Noem and President Donald Trump concluded that “Haiti no longer meets the statutory requirements for TPS.”

Homeland Security Secretary Kristi Noem made the decision after President Trump’s initial attempts to cut the TPS protections of Haitian migrants earlier this year. They fell unsuccessful as they were stalled in federal court.

While addressing the end to TPS, Noem acknowledged the current status of Haiti. Currently, it faces humanitarian and political issues, and what Noem called “widespread gang violence.” However, she doubled down on the claim that by extending the TPS policy, it goes against current U.S. interests.

The USCIS statement read:

“The Department of Homeland Security today posted a Federal Register notice on the termination of Temporary Protected Status for Haiti. This decision was based on a review conducted by U.S. Citizenship and Immigration Services, input from relevant U.S. government agencies, and an analysis indicating that allowing Haitian nationals to remain temporarily in the United States is inconsistent with U.S. national interests.

The termination of the Haiti Temporary Protected Status designation is effective February 3, 2026. If you are an alien who is currently a beneficiary of TPS for Haiti, you should prepare to depart if you have no other lawful basis for remaining in the United States. You can use the CBP Home mobile application to report your departure from the United States. This secure and convenient self-deportation process includes a complimentary plane ticket, a $1,000 exit bonus, and potential future opportunities for legal immigration to the United States.
