In a new report by Rolling Stone, Diddy has filed his first motion against the woman who claims she was “gang raped” at 17 years old while at his Manhattan recording studio in 2003.

The news outlet reports that new court filings was made Tuesday and Diddy once again denied that he, Harve Pierre and another unidentified man gave the woman who says she was 17 years old at time, “copious amounts of drugs and alcohol” and took turns raping her in a bathroom of his Daddy’s House Recording Studio.

“(Combs) never participated in, witnessed, or was or is presently aware of any misconduct, sexual or otherwise, relating to plaintiff in any circumstance whatsoever,” the court filings read.

In the documents Diddy’s lawyer also spoke on the timing of the lawsuit and addressed the alleged photo that surfaced on social media of the woman allegedly sitting on Diddy’s lap in the studio. “The context, genuineness, and/or accuracy of the photographs are disputed,” his answer states. “Plaintiff’s decision to wait more than two decades to file her complaint has prejudiced defendant, as he has lost the ability to defend himself fully and fairly in this action,” he says. “For example, some or all evidence that otherwise would have been available if the action had been promptly commenced may be unavailable, lost, or compromised.” Combs and his lawyers further argue the lawsuit should be barred because the Victims of Gender-Motivated Violence Act (GMVA) under which is was brought is purportedly “unconstitutional.”

“Allowing this action to proceed violates defendant’s rights under the U.S. Constitution and the New York State Constitution,” Diddy’s legal team stated.

After Diddy’s fourth lawsuit made headlines the mogul released a statement denying the allegations against him. “Enough is enough. For the last couple of weeks, I have sat silently and watched people try to assassinate my character, destroy my reputation and my legacy. Sickening allegations have been made against me by individuals looking for a quick payday. Let me be absolutely clear: I did not do any of the awful things being alleged. I will fight for my name, my family and for the truth,” the statement said.

Pierre also previously denied the allegations while speaking with TMZ. “This is a tale of fiction. I have never participated in, witnessed, nor heard of anything like this, ever. These disgusting allegations are false and a desperate attempt for financial gain.” He continued, “I will vigorously protect my reputation and defend my name. Those who know me recognize that these claims are not true.”
