In July 2022, Andrea Serrano,31, was arrested for sexual assault on a child, and her charges were reduced in February to incest after she accepted a plea deal. The plea deal included ten years to life on a sex offender supervised probation without jail time, but an El Paso County judge gave her 90 days in jail despite the previous plea agreement, as reported by PEOPLE.
The victim’s mother requested to put Serrano behind bars as there were no apparent consequences for her crime.”It sets a bad example for the community. … There are no consequences. This isn’t right. … She needs to go to jail,” the teen’s mother said. During the plea hearing, Serrano apologized to the family: “I just want to say I’m sorry.”

Additionally, the teen’s mother said her son was exposed to drugs and alcohol despite knowing the boy since he was a baby. His attorney said it was “fictitious” to have Serrano charged with incest when she’s not a blood relative and deserves to serve real jail time for her actions.
Prosecutors argued that a jail sentence wouldn’t benefit the welfare of Serrano’s newborn baby and the minimum of 10-year sex offender intensive supervision would be more reasonable. In a report by The Gazette, her defense attorney agreed with prosecutors stating her client wants to be with her children.
Social media users react to the decision and feel that Serrano should serve more time in jail.
After the latest update, Twitter users were stunned by the judge’s decision to have Serrano serve only 90 days in jail.
@DailyLoud Wow, 90 days behind bars for a crime that will have a lifetime impact on the victim and child. What a fair justice system we have!

Wtf? She was also charged with incest, so was the 13 year old closely related to her? 90 days behind bars and that’s it? What kind of example is this setting for our children? Absolutely Sickening!! Our systems are broken! https://t.co/DyYQlDFVjS

Surprising considering the fact that Colorado’s assault laws are wildly punitive, surprisingly often more so for women. I’m not excusing her behavior I am just surprised she only got 90 days considering the insane convictions I’ve seen for much less, but I’m not a legal expert🤷🏻♀️ https://t.co/6uT43ma1Cc
