The documentation states that the judge should acquit the former police officer’s murder charge because she acted in self-defense after mistaking Botham Jean’s apartment for her own. The appeal also requests for Guyger to face a lesser charge and a new hearing due to the evidence of her prior trial was “legally insufficient to prove beyond a reasonable doubt that Guyger committed murder.”

At the time of Jean’s death, Guyger was still wearing her police uniform and claimed she was off-duty. After entering his apartment, she fired several shots believing she walked into her own apartment and mistook him for an intruder. Her attorneys also argued that Guyger’s error “negated the culpability of murder because although she intentionally and knowingly caused Jean’s death, she had the right to act in deadly force of self-defense,”
