A former Amazon warehouse employee who had irritable bowel syndrome has filed a lawsuit against the company after she was fired for taking too many bathroom breaks.

Maria Iris Jennitte Olivero filed the lawsuit in June, seeking damages against her former employer for firing her over bathroom policies. The case was moved earlier this month from New Jersey Superior Court to federal court after Amazon responded to the lawsuit. Her lawsuit states during her time as an Amazon employee from July 2020, Olivero suffered from irritable bowel syndrome and used the bathroom frequently during her shift at a warehouse.
In November of that year, she informed her manager about her diagnosis and needed to use the bathroom approximately six times a day. However, they told her she needed to provided a doctor’s note or she’ll be written up. Two months later, her manager issued the warning again and said she needed to provide the note within five days.

According to Insider, the complaint said:”At that time, [Olivero] was informed by [her manager] that it was ‘too late’ to provide a doctor’s note and that she was being terminated by Defendants.” Olivero is suing the company for discrimination against an individual with disabilities and failing to accommodate based on the state’s law. A spokesman from the company says she’s seeking more than $75,000 in damages.
