Fatal Shooting That Killed Cinematographer In Alec Baldwin Gun Accident Officially Ruled An ‘Accident’

The fatal shooting that took the life of cinematographer Halyna Hutchins on a film set in October has been ruled an accident, according to the New Mexico’s Office of the Medical Investigator report. As most will recall, actor Alec Baldwin was on the set of his movie “Rust” when he was rehearsing a scene involving what was supposed to be a prop gun — but in a tragic turn of events, the firearm was loaded, and when Baldwin allegedly pulled the trigger, the bullet hit Hutchins and subsequently killed her.

While Baldwin previously claimed he did not pull the trigger, an FBI forensic report obtained by ABC News this week stated that the bullet that killed Hutchins could not have been fired without the trigger being pushed, noting that the film’s director Joel Souza had also been left injured in the shooting. Now, the medical investigator’s report has released a statement of their own, insisting that following an autopsy and review of police reports, the tragic incident has been ruled an accident.

Baldwin’s attorney Luke Nikas said of their latest findings, “This is the third time the New Mexico authorities have found that Alec Baldwin had no authority or knowledge of the allegedly unsafe conditions on the set, that he was told by the person in charge of safety on the set that the gun was ‘cold,’ and believed the gun was safe.”

Prosecutors are reportedly still trying to determine whether to charge the Hollywood star in the case while reviewing the latest reports, including the aforementioned results found by the FBI. A string of information has yet t be sent to them including cell phone data from Baldwin’s legal team, though it seems unlikely that the actor will be prosecuted for the unfortunate situation.

The state’s medical investigator’s office added that the shooting would have been accidental because there had been an “absence of obvious intent to cause harm or death,” adding that there was no compelling demonstration to conclude that the firearm was intentionally loaded with live rounds with the intent to kill a crew member on set.

“The trigger wasn’t pulled,” Baldwin told ABC News in December. “I didn’t pull the trigger,” stressing he had “cocked it.”

Furthermore, while the FBI claimed that the trigger must have been pulled, Nikas begs to differ, saying, “The gun fired in testing only one time — without having to pull the trigger — when the hammer was pulled back and the gun broke in two different places. The FBI was unable to fire the gun in any prior test, even when pulling the trigger, because it was in such poor condition.”
