A lawsuit has been filed against a Texas restaurant after a customer reportedly discovered a cow tooth in their food.

According to KVUE, the incident occurred on June 9 when the customer ordered a “Democrat” taco from Tochy’s Taco on Congress Ave. The customer claims to have been horrified upon finding the tooth and subsequently visited a doctor that day. The restaurant’s manager was reportedly informed about the incident, but it remains unclear whether he took any steps to rectify the issue within his control.

Lawsuit Seeks Up to $250,000

The lawsuit seeks a settlement of $250,000 or less, as the customer alleges that the establishment was negligent in selling a product that did not meet safety standards.

Attorney Scott Vasquez expressed his concern to the outlet, stating that the restaurant should have been aware of the potential hazard posed by a non-food item being included in the menu. He emphasized the serious risk of choking that could occur.

Torchy’s released a statement to the outlet after news of the lawsuit.

“We are aware of the situation and take all concerns about our food seriously. We source the highest quality food available, which means our barbacoa comes from natural beef cheek that we source from a supplier. Food safety is a top priority, and we maintain robust food handling, preparation and quality control procedures. Upon receiving the guest complaint, we conducted a thorough review and identified the item as a cow tooth. This can occasionally happen when processing the meat, though it is quite rare. We have partnered with our supplier to reinforce their internal procedures to prevent this from happening in the future. “
