Jennifer Haisten accused the fast food restaurant on Rancho Drive of serving her a hamburger with glass particles. The lawsuit described her pain as “overwhelming, intense, and excruciating” since the food allegedly broke her teeth.

“When she began to consume the hamburger prepared and cooked by Wendy’s and provided to her at the pick-up window, she experienced a tremendous sense of shock and fear as her hamburger was not juicy and tender as expected, but instead consisted of hard and clear glass-like particles that not only created loud crunching and breaking sounds but in fact these hard and clear glass-like particles actually broke many of Ms. Haisten’s teeth,” the lawsuit states.

Haisten is asking for a jury trial in Clark County and damages at a maximum of $15,000. Wendy’s did not release a statement regarding the situation.

Another woman, Jena Vogt, is suing the fast food chain after she was hospitalized for consuming a cheeseburger that allegedly contained a preformed toxin. She purchased the cheeseburger from Wendy’s restaurant in St. Rose, Louisiana, on July 27.

The burger was reportedly contaminated due to “poor handwashing procedures” and not properly inspected before it was served. Vogt was diagnosed with multiple medical issues, which included sepsis, E.coli, septic shock, cerebral hemorrhage, and acute GI bleeding.

Notable Wendy’s lawsuit throughout the years

Wendy’s, the fast-food restaurant chain, has faced several lawsuits over the years. Here are some notable examples:

  1. Data Breach Lawsuits: In 2016, Wendy’s suffered a data breach that affected over 1,000 locations. As a result, several class-action lawsuits were filed against the company. The lawsuits claimed that Wendy’s was negligent in protecting customers’ personal and financial information. In 2019, Wendy’s agreed to pay $50 million to settle the lawsuits.
  2. Sexual Harassment Lawsuits: In 2018, several female employees filed a lawsuit against a Wendy’s franchisee in Illinois, claiming that they were subjected to sexual harassment and retaliation. The lawsuit alleged that the franchisee failed to take appropriate action to address the harassment and retaliated against the employees who complained. The case was settled in 2020 for an undisclosed amount.
  3. Misleading Advertising Lawsuits: In 2011, Wendy’s faced a class-action lawsuit over its advertising claims regarding its “natural-cut” fries. The lawsuit claimed that the fries were not actually natural because they contained preservatives. Wendy’s settled the lawsuit for $1.5 million.
  4. Wage and Hour Lawsuits: In 2016, Wendy’s faced a class-action lawsuit in California over alleged wage and hour violations. The lawsuit claimed that Wendy’s failed to pay its employees for all hours worked, provide meal and rest breaks, and pay overtime. The case was settled for $1.5 million.

Like many large companies, Wendy’s has faced various legal challenges over the years, but it has also taken steps to address these issues and improve its practices.
