The family’s wrongful death settlement was filed in Los Angeles County by General Anesthesia Specialists who were listed as defendants as reported by The Blast. Paxton’s family claimed the company was liable for his death after he underwent routine heart surgery. However, the company has denied any responsibility despite the settlement.

Court documentation also stated that the company is treating the settlement as a “business decision” and it is “contingent on a judge’s sign-off.” Additionally, GAS said they are avoiding exposing Paxton’s widow, Louis Newbury, and their children to “an expensive and time-consuming litigation” in reference to their upcoming trial on Sept. 19.

Other defendants listed in the suit were Cedars-Sinai Medical Center and Dr. Ali Khoynezhad, the cardiothoracic surgeon who is currently employed at the hospital. The lawsuit claims the hospital and its staff were negligent with his diagnosis, treatment, and management which led to his death.

“[The defendant] “misrepresented and/or concealed information relating to the risks of surgery and care that would be provided and/or failed to adequately explain the proposed treatment or procedure.”
