Jussie Smollett’s Case Will Not Be Dismissed, Trial Set For Nov. 29

On Friday, a Chicago judge denied Jussie Smollett’s request to dismiss the criminal case against him and has set a trial date for Nov. 29 in connection with the reported “hate hoax.”

As we previously reported, the former “Empire’” star is accused of lying to police when he reported that he was the victim of a racist, anti-gay attack in Chicago in 2019.

However, an attorney for the actor argued that Smollett’s rights were being violated since he had already done community service and given up a $10,000 bond under a previous deal with Cook County prosecutors to drop charges. Attorney Nenye Uche noted, “A deal is a deal. That’s ancient principle.” Despite that, Judge James Linn noted that Smollett’s case now was being led by a special prosecutor appointed by another judge. Linn said jury selection in Smollett’s trial would start on Nov. 29.

Abel and Ola Osundairo, the men accused of helping orchestrate the attack were detained and questioned by police on February 13, 2019 but were released days later. It was said that Smollett allegedly agreed to pay them $3,500 to stage the attack. 

That case, however, was dropped on March 26 by the Cook County State’s Attorney’s Office in return for the actor forfeiting the $10,000 bond he paid. But the City of Chicago would later sue Smollett for $130,000 for the cost of the investigation.
